Why The Penalty Group Changes A Texas Manufacturing Charge

The substance involved sets the Penalty Group, and the group drives charging severity. Penalty Groups 1 and 1-B, which include methamphetamine, cocaine and fentanyl, carry the harshest ranges. Penalty Groups 2 through 4 cover drugs like ecstasy and many prescription medications, with lower ranges at the same weight. The same statute covers delivering a controlled substance, so both charges often appear together.

How Aggregate Weight Sets Texas Manufacturing Sentences

Texas measures aggregate weight, including any adulterants and dilutants mixed with the drug. Cutting agents count toward the total. For Penalty Group 1, less than one gram is a state jail felony. At 400 grams or more, the range is 15 to 99 years or life in prison.
